Terms of use

These Terms of Use (the "Terms") are a binding agreement between you and [COMPANY LEGAL NAME], a company registered in Morocco under number [RC NUMBER], with its registered office at [ADDRESS] ("Mooviro", "we"). They govern your use of the Mooviro app and website (the "Platform"). By creating an account or using the Platform, you accept these Terms. If you do not accept them, do not use the Platform.

1. What Mooviro does

Mooviro is an online platform that puts people who want to rent a car ("Renters") in contact with car rental agencies ("Agencies"). Mooviro is not a car rental company. It does not own, rent out or operate any car, and it is not a party to any rental contract. Mooviro does not act for anyone as an agent, broker, insurer, guarantor or payment provider.

2. Your account

You must be at least 18 years old, have the legal capacity to enter into contracts, and sign in with a Moroccan mobile number that is yours.

You are responsible for everything done through your account. Keep access to it secure.

An Agency must be a lawfully registered car rental business that holds every licence, authorisation and insurance required by law. The person who registers it must be authorised to act on its behalf.

3. True information and good faith

You must give true, accurate and complete information, including your identity, documents, listings, prices and car details, and keep it up to date.

The Platform relies on the information users provide. Mooviro may review some of it, such as agency documents and car listings, but does not guarantee that any user, car, document or information is genuine, accurate or lawful.

You must act honestly and in good faith towards Mooviro and other users.

4. Bookings and the rental contract

A booking request is an offer by the Renter to rent a car. It becomes binding only when the Agency accepts it in the app.

The rental contract is made directly between the Renter and the Agency, on the Agency's own conditions and the written rental contract signed at pickup. Mooviro is not a party to it.

The Agency alone decides whether to accept a request, and must provide the car as described in its listing.

5. Prices, payments and deposits

Each Agency sets its own prices, deposits and rental conditions.

All payments, including the rental price and the deposit, are made directly between the Renter and the Agency at pickup. Mooviro does not receive, hold, transfer or refund any money, and is not responsible for any payment, deposit, refund or other money matter between users.

6. Responsibility for bookings

The Renter and the Agency are each solely responsible for their own obligations under the booking and the rental contract, and for any issue arising from them, including the condition of the car, damage, accidents, insurance, traffic fines, fuel, mileage, late return, cancellation, payments and deposits.

The Agency is responsible for its cars being lawfully registered, insured, roadworthy and as described.

The Renter is responsible for the car during the rental, for driving it lawfully with a valid licence, and for returning it on time and in the agreed condition.

7. Disputes between Renters and Agencies

Any dispute about a booking or a rental is between the Renter and the Agency only, and they must settle it directly with each other.

Mooviro is not a party to such disputes and is not responsible for their outcome. Mooviro may, at its own discretion, help (for example by sharing the booking details it holds), but it has no obligation to do so.

8. Fraud and misuse

Mooviro is not responsible for fraud, deception, false information or other misconduct by any user, whether on or off the Platform.

You must not: give false information or use another person's identity; publish fake or misleading listings; ask for or make any payment before pickup or outside the agreed rental; or misuse, copy or disrupt the Platform.

Report any suspected fraud to Mooviro and, where appropriate, to the police. Mooviro may suspend or close any account involved.

9. Mooviro's liability

The Platform is provided "as is" and "as available". Mooviro does not guarantee that it will always be available or free of errors, or that any car will be available.

To the fullest extent permitted by law, Mooviro is not liable for any loss or damage arising from a booking, a rental, the conduct of any user, or information provided by users.

Nothing in these Terms limits any liability that cannot be limited under Moroccan law, including Mooviro's liability for its own fraud or gross negligence.

10. Your liability to Mooviro

You will compensate Mooviro for any claim, loss or cost, including reasonable legal fees, that results from your breach of these Terms, from false information you provide, or from your rentals and dealings with other users.

11. Content you share

You remain the owner of the content you upload, such as photos and listings. You allow Mooviro, free of charge, to store, display and use it to operate and promote the Platform. You confirm that you have the right to share it.

12. Suspending and closing accounts

Mooviro may suspend or close an account that breaches these Terms or the law, or that puts other users at risk.

You may ask to delete your account in the app at any time, unless a booking request or rental is still open. Your account is closed at once and fully deleted 30 days later. You can reactivate it by signing in again before then. Booking records are kept for as long as the law requires.

13. Personal data

Mooviro processes your personal data as described in its Privacy Policy and in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data. [CNDP DECLARATION NUMBER]

14. Changes to these Terms

Mooviro may change these Terms. We will tell you in the app before an important change takes effect. If you continue to use the Platform after that, you accept the new Terms.

15. Governing law and courts

These Terms are governed by Moroccan law. Any dispute between you and Mooviro will be brought before the competent courts of Tangier, subject to the mandatory rules that protect consumers.

16. Languages and contact
